These Terms and Conditions ("Terms") govern your use of the OBox MyCloud application ("Application") for mobile devices, created by Situs Technologies LLC ("Service Provider", "we", "us", or "our") as a Freemium service.
By downloading, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.
1. Acceptance of Terms
Upon downloading or utilizing the Application, you automatically agree to these Terms. We strongly advise that you thoroughly read and understand these Terms prior to using the Application.
2. Description of Service
OBox MyCloud is a VPN deployment and management tool that enables users to:
- Deploy private VPN servers on cloud platforms (DigitalOcean, AWS, etc.)
- Manage and configure VPN servers
- Control user access to their VPN infrastructure
Important: We do NOT operate VPN servers or route any user traffic through our infrastructure. Users deploy and manage their own VPN servers on their chosen cloud platform using their own cloud provider accounts.
3. Account Registration and Security
Account Creation
- You must provide accurate and complete information during registration
- You must be at least 13 years old (or 16 in some jurisdictions) to use the Application
- One person or legal entity may not maintain more than one account without permission
Account Security
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- Notify us immediately at service@situstechnologies.com of any unauthorized use
Password Requirements
- Use a strong, unique password
- Do not share your password with others
- We will never ask for your password via email or phone
4. Cloud Provider Requirements
Third-Party Accounts Required
- You must have your own account with a supported cloud provider (DigitalOcean, AWS, etc.)
- You are responsible for complying with your cloud provider's terms of service
- You are responsible for all charges from your cloud provider
API Credentials
- API keys and access tokens are stored locally on your device
- You are responsible for the security of your cloud provider credentials
- We do not store or have access to your cloud provider credentials on our servers
5. Subscription and Payment Terms
Free Tier
- Basic features are available at no cost
- Subject to limitations as described in the Application
Premium Subscription
- Premium features require a paid subscription
- Subscriptions are processed through Apple's App Store
- Pricing is displayed in the Application and App Store
- Subscriptions automatically renew unless cancelled 24 hours before the renewal date
Refund Policy
- Refund requests are subject to Apple's App Store refund policy
- Contact Apple Support for refund inquiries
- No refunds will be provided for partial subscription periods
Payment Processing
- All payments are processed by Apple
- We do not collect or store your payment information
- You are responsible for applicable taxes
6. User Responsibilities and Prohibited Uses
You agree NOT to:
- Use the Application for any illegal purposes or activities
- Deploy VPN servers to violate any laws or regulations
- Attempt to circumvent security measures or access restrictions
- Interfere with or disrupt the Application or servers
- Transmit malware, viruses, or malicious code
- Violate the terms of service of cloud providers
- Use the Application to infringe on intellectual property rights
- Engage in spam, phishing, or fraudulent activities
- Attempt to reverse engineer, decompile, or extract the source code
- Remove, obscure, or alter any proprietary notices
- Use the Application in a manner that violates export control laws
Acceptable Use
- You are solely responsible for your VPN server usage and content
- You must comply with all applicable laws in your jurisdiction
- You must respect the intellectual property rights of others
7. Intellectual Property Rights
Ownership
- All trademarks, copyrights, database rights, and intellectual property rights related to the Application remain the property of the Service Provider
- You are granted a limited, non-exclusive, non-transferable license to use the Application
Restrictions
- Unauthorized copying or modification of the Application is strictly prohibited
- Attempts to extract source code, translate, or create derivative versions are not permitted
- You may not sell, rent, lease, or distribute the Application
8. Device and Network Requirements
Internet Connection
- The Application requires an active internet connection (Wi-Fi or mobile data)
- We are not responsible if the Application does not function due to lack of connectivity
Device Compatibility
- You are responsible for ensuring your device meets system requirements
- The Service Provider is not responsible for device-specific issues
Device Security
- We strongly advise against jailbreaking or rooting your device
- Such modifications may compromise security and cause the Application to malfunction
- Use on modified devices is at your own risk
Data Charges
- You are responsible for any data charges from your mobile network provider
- This includes roaming charges when using the Application outside your home region
- If you are not the bill payer, ensure you have permission to use the Application
9. Third-Party Services and Content
Cloud Providers
- The Application integrates with third-party cloud platforms
- We are not responsible for the availability, content, or practices of these third-party services
- You must comply with the terms of service of your chosen cloud provider
Links to Third-Party Websites
- The Application may contain links to third-party websites
- We are not responsible for the content or practices of linked websites
- Access third-party websites at your own risk
10. Service Availability and Modifications
Service Changes
- We reserve the right to modify, suspend, or discontinue the Application at any time
- We may change pricing or add new fees with advance notice
- We do not guarantee uninterrupted or error-free service
Updates and Maintenance
- We may update the Application to add features, fix bugs, or improve performance
- You agree to accept updates when offered
- Continued use of outdated versions may result in reduced functionality
Feature Changes
- We reserve the right to add, modify, or remove features
- We will provide reasonable notice of significant changes when possible
11. Limitation of Liability
To the Maximum Extent Permitted by Law:
- The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
- We do not warrant that the Application will be error-free or uninterrupted
- We are not liable for any loss of data, profits, or business opportunities
- We are not responsible for issues caused by cloud provider downtime or failures
- We are not liable for your use or misuse of deployed VPN servers
Disclaimer of Warranties
- We make no warranties regarding the accuracy, reliability, or completeness of information
- We do not guarantee specific results from using the Application
Indemnification
You agree to indemnify and hold harmless the Service Provider from any claims, damages, losses, or expenses arising from:
- Your violation of these Terms
- Your use of the Application or deployed VPN servers
- Your violation of any third-party rights
- Your violation of applicable laws or regulations
12. Privacy and Data Protection
Data Collection
- Our collection and use of personal information is governed by our Privacy Policy
- By using the Application, you consent to our Privacy Policy
Data Security
- We implement reasonable security measures to protect your data
- However, no method of transmission over the internet is 100% secure
- You are responsible for the security of data on your deployed VPN servers
13. Termination
Termination by You
- You may terminate your account at any time by contacting us
- Uninstalling the Application does not automatically delete your account
Termination by Us
- We may terminate or suspend your account immediately if you violate these Terms
- We may terminate service for any reason with reasonable notice
Effect of Termination
Upon termination:
- Your right to use the Application will cease immediately
- You must delete the Application from your device
- Outstanding fees remain payable
- Certain provisions of these Terms will survive termination
Your Responsibilities Upon Termination
- You are responsible for backing up any data before termination
- You are responsible for deleting or maintaining any deployed VPN servers with your cloud provider
- We are not responsible for data loss resulting from account termination
14. Governing Law and Dispute Resolution
Governing Law
These Terms are governed by the laws of the United States and the state where Situs Technologies LLC is registered.
Dispute Resolution
- We encourage you to contact us first at service@situstechnologies.com to resolve any disputes
- Most concerns can be resolved quickly through direct communication
- Any legal disputes will be handled in accordance with applicable laws
15. Changes to These Terms
Updates
We may update these Terms from time to time. We will notify you of significant changes by:
- Posting the updated Terms in the Application
- Sending an email notification (if you have an account)
- Updating the "Last Updated" date at the top of this page
Your Continued Use
- Continued use of the Application after changes constitutes acceptance of the updated Terms
- If you do not agree to changes, you must stop using the Application
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Service Provider regarding the Application and supersede any prior agreements.
18. No Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
19. Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
